<p style="margin-top:-20px;">Self-Certification for MN Commercial Drivers Now in Effect</span></em></strong></p>
<p><em><span style="font-size: medium;">CDL Applicants Required to Declare Their Type of Operation and Medical Certification Status</span></em></p>
<p><span style="font-size: medium;">The Minnesota Department of Public Safety Driver and Vehicle Services Division (DVS) announced that beginning January 30, those who apply for or renew commercial driver’s licenses (CDL) will need to self-certify to a single type of commercial operation. Based on that self-certification, a CDL holder may need to provide a current medical examiner’s certificate along with any waivers required to maintain commercial driver status.</span></p>
<p><span style="font-size: medium;">Federal Motor Carrier Safety Regulations and Minnesota statutes require all CDL holders to self-certify in one of the following categories. Categories and medical examiner’s certificate requirements are determined by the Code if Federal Regulation (CFR) and state statute.</span></p>
<p><span style="font-size: medium;"><strong>Category 1</strong> – Non-exempt Interstate: Driver is subject to 49 CFR, part 391 and must present a current medical examiner’s certificate and applicable waivers. (Our Drivers are catetory 1)</span></p>
<p><span style="font-size: medium;"><strong>Category 2</strong> – Exempt Interstate: Driver is exempt from the medical examination requirements of 49 CFR, part 391</span></p>
<p><span style="font-size: medium;"><strong>Category 3</strong> – Non-exempt Intrastate: Driver is subject to the medical examination requirements of Minnesota Statutes, Chapter 221 and must provide a current medical examiner’s certificate and applicable waivers</span></p>
<p><span style="font-size: medium;"><strong>Category 4</strong> – Exempt Intrastate: Driver is exempt from the medical examination requirements of Minnesota Statutes, Chapter 221.</span></td>

<p><strong><em><span style="text-decoration: underline;">Fatigue Management</span></em></strong></p>
<p>Driver fatigue is one of the hottest topics in trucking today. Fatigue management will play a part of future hours-of-service changes and the media always seems to show interest, especially after a major crash. For the last couple of years, we have heard stories of tragedies occurring when a truck driver falls asleep at the wheel. Besides the loss of life, cargo, and equipment, attorneys are asking for large settlements from carriers by making the jury believe the fatigued driver contributed to the severity of the accident.</p>
<p>There is no doubt driver fatigue is an important safety issue. The increased attention has provided the trucking industry with quite an education on the fatigue issue. Here are some tips that can help you stay alert:</p>

<p><strong></p>
<p>1. Don’t let log books control sleep patterns.</strong> The hours of service rules are meant to apply to a broad range of drivers, but every person sleeps differently. Never drive over the hour-of-service standard, and always pull over and rest in a safe area when needed.<br />
<br />
<strong>2. Allow yourself time to wake up before starting out.</strong>Most people have trouble waking up and immediately begin driving. Sleep inertia, a physical state in which the body is recovering from sleep, can seriously limit driving ability. Make sure you are completely awake before you start to drive.<strong><br />
<br />3. Be aware of key drowsiness times.</strong>When the sun shines directly into the truck at sunrise and at sunset, is when you are at the greatest risk of fatigue. Since these times of day usually correspond with the presence of heavy traffic, driving performance should be closely monitored.&nbsp;</p>

</strong><strong> to the Hours-of-Service Regulations</strong><strong> </strong></p>
<p>On December 22, 2011, FMCSA publicly announced controversial Hours of Service rule changes. The key elements of this rule are described below.</p>
<p>&nbsp;</p>
<p><strong>Maximum Driving Hours</strong> – FMCSA retained the current 11-hour driving time limit, but placed a limit on the number of consecutive driving hours. No driving may occur if more than eight consecutive hours have passed since the last break of 30 minutes or more.</p>
<p>&nbsp;</p>
<p><strong>Restart</strong> – Any restart period must include two consecutive nighttime periods (from 1 a.m. to 5 a.m.), and must be at least 34 consecutive hours long. Drivers are permitted to use the restart provision only once in any seven calendar days.</p>
<p>&nbsp;</p>
<p><strong>14 Consecutive Hour Day (now called Driving Window)</strong> &#8211; The rule retains a 14 consecutive hour driving window. With a 30 minute rest break, maximum on-duty time within a 14 hour window is 13.5 hours. No driving may occur after 14 consecutive hours since coming on duty; non-driving work is allowed past the 14 hour driving window.</p>
<p>&nbsp;</p>
<p><strong>Mandatory Rest Break</strong> – Drivers will not be permitted to drive if eight hours have passed since their last break of 30 minutes or more. (Only one break may be required depending upon time).</p>

<p><strong>Off-Duty in A Parked CMV or In Passenger Seat</strong> – The rule allows drivers to record time spent in a parked CMV as off-duty time. Also, team drivers would be permitted to record up to two hours of time spent in the passenger seat of a CMV in operation as off-duty time, if it is just before or after an eight hour sleeper berth period.</p>
<p>&nbsp;</p>
<p>Oilfield Exemption – Waiting time at an oil well or natural gas site will not count toward calculation of the 14 hour window but must be recorded as off-duty on a paper or electronic log.</p>
<p>&nbsp;</p>
<p>Egregious Violations – A driver who exceeds, and/or a motor that allows a driver to exceed, the driving time limit by three hours or more be considered to have committed an egregious violation and be subject to the maximum civil penalties of $2,700 for drivers and $11,000 for motor carriers – for each offense.</p>
<p>&nbsp;</p>
<p>Effective Date &amp; Compliance Date – This rule will be effective in late February 2012, and the oilfield exemption change must be implemented by then. However, interstate motor carriers and drivers will not be required to comply with the remainder of the new rules (restart change, rest break requirements, etc.) until July 1, 2013.</p>

<p align="center"><strong>LOG REVIEW</strong></p>
<p>When completing your daily logs there are a couple of things that get overlooked, causing more work for our logging auditing department.</p>
<p>1.  Please be sure to check the pre-trip and post-trip boxes on the bottom right corner of your daily log, in addition to writing it in the remarks area. Remember to show a minimum of 15 minutes for your pre-trip, as well as flagging the post-trip with the number of minutes spent on the post-trip and then complete the back of your log (don’t forget to sign the back of the log).</p>
<p>2. When you are off-duty and completing your off duty log, the date that goes on the log is the first day that you were off and if you were off more than one day, put the number of days in the box at the bottom of your log. Draw a continuous line through the grid on line “one” and put 24 in the total-hours box (do not add up the number of hours by the days off, the log scanner will do that).</p>
<p>3. Your daily log consists of three (3) pages and you are required to use all three (3) pages. The top cover goes to the long auditing department, the 1<sup>st</sup> blue copy goes to Darrell, in the shop (regardless if there are defects that need addressing), and the 2<sup>nd</sup> blue copy is your record of duty.</p>
